This entire song is played in the key of Eb in dorian mode - that'd be an Eb dorian scale. This is very close to standard Eb minor scale. The only difference is the minor 6th step in the scale, which is raised to a major 6th step. The note B is then included instead of the note C. Chordwise the main groove of this solo goes Ebm7 and Ab7. Notice this because the dorian scale is exposed in the second chord. The note C appears as the major 3rd in Ab7. If the note B was included instead, as in a standard minor mode, it would be the minor 3rd making the chord Abm7 instead. The dorian scale could also be interpreted as a regular Db major scale - with 2nd step, Eb, as starting and ending point.
